Terms of Use

The agreement between you and FoodBuddy, in plain language. Please read sections 3 and 4: they explain what the numbers in the app can and cannot do.

1. Who provides FoodBuddy

FoodBuddy is provided by NECULAI RAUL - INOCENȚIU PERSOANĂ FIZICĂ AUTORIZATĂ ("we", "us"), Romania. Contact: contact@neculairaul.com. Full details are on the provider information page.

These terms apply to the FoodBuddy app for iPhone. You accept them when you start using the app, and the app records that you did. Our Privacy Policy explains how we handle your data.

2. Who can use FoodBuddy

  • You must be 16 or older. People aged 16 and 17 can only use a maintain goal.
  • If you are pregnant or breastfeeding, FoodBuddy only offers a maintain goal, and your target cannot go below what it is today.
  • FoodBuddy is offered in the European Union and EEA, the United Kingdom and Switzerland.

3. Not medical advice

FoodBuddy gives general information, not medical advice. Targets are estimates from standard formulas. If you have a medical condition, are pregnant or breastfeeding, or have a history of disordered eating, talk to a healthcare professional.

For your safety, FoodBuddy never sets a calorie target below 1,000 kcal a day, limits how big a deficit it suggests, and changes an adaptive target by at most 150 kcal a week. These limits are safeguards, not a recommendation for you. FoodBuddy does not diagnose, treat or prevent any condition. If you feel unwell, stop and speak to a doctor.

4. AI features

Label scan, describe it, snap a meal and recipe import use AI. When you use them:

  • Results are estimates and can be wrong. Estimates from a meal photo are rough, typically ±20–30 %. You review every item and amount before it is saved, and you are responsible for what you log.
  • Each feature asks for your consent first. You can turn it off any time in Settings → Privacy.
  • Daily limits apply to keep the service free and fair. With an account, per day: 5 label scans, 30 descriptions, 5 meal photos and 10 recipe imports (lower for guests). We may change limits, and AI features may be unavailable at times.
  • Photograph only food, labels and recipes. Please avoid faces, documents and receipts.

Nutrition values for described and photographed meals come from food databases, not from the AI. More on the How we use AI page.

5. Food data

Food data comes from Open Food Facts (Open Database Licence), CIQUAL by ANSES (Licence Ouverte / Etalab 2.0), USDA FoodData Central (public domain, CC0) and from FoodBuddy users. Each food shows where its numbers come from. Databases and labels can contain mistakes: check the packaging when it matters, and use "Report" on a food to tell us about an error.

6. Your content

You keep ownership of what you create in FoodBuddy: your diary, notes, recipes and foods.

  • Private content is used only to provide FoodBuddy to you.
  • Community foods and reports. When you share a food with the community or report or confirm a food, you give us a free, non-exclusive, worldwide, permanent licence to store, show, correct, combine and share it with other FoodBuddy users. This continues after you delete your account, without your name. Only share what you are allowed to share.
  • Partner entries and notes are delivered to the partner you choose, and nothing else is done with them.

7. Acceptable use and objectionable content

Do not put offensive, hateful, sexual, violent or harassing content, personal data of others, or spam into food names, brands, serving labels, recipes, notes or anything you share or send to a partner. Do not misuse FoodBuddy: no scraping, no bypassing limits, no attacks on the service, no use against the law.

  • How to report: open the food and tap "Report", or email contact@neculairaul.com with the food name or a screenshot. To stop receiving entries from a partner, unpair in Partners and tell us if their content was abusive.
  • What we do: we review reports of objectionable content within 24 hours, remove content that breaks these rules, and may suspend or close the accounts responsible.

8. Accounts and guest use

You can sign in with an email code, with Apple or with Google, or start as a guest. Keep access to your email and devices secure; you are responsible for activity on your account. A guest account is an anonymous account on our server: signing out as a guest deletes it, and guest accounts with no activity for 30 days are deleted automatically. Create a free account to keep your diary and to use partners and community sharing.

9. Price

FoodBuddy is free and has no ads. The barcode scanner, macro tracking, data export and account deletion will never be behind a paywall. If we ever offer paid extras, they will come with separate terms and clear prices, and nothing will be charged without your explicit purchase.

10. Changes, availability and ending

  • We keep improving FoodBuddy and may change or remove features. We do not promise uninterrupted availability.
  • If we change these terms in a way that matters, we tell you in the app before the change applies. If you do not agree, you can stop using FoodBuddy and delete your account.
  • You can end this agreement at any time by deleting your account in Settings → Account & data → Delete account.
  • We may suspend or close an account that seriously or repeatedly breaks these terms. Except in urgent cases, we tell you first and give you a chance to download your data.

11. Liability

FoodBuddy is provided free of charge. We take care to make it accurate and reliable, but we cannot guarantee that every value is correct or that the app is always available. To the extent the law allows, we are not liable for indirect losses or for decisions you make based on estimates in the app.

Nothing in these terms limits our liability for intent or gross negligence, for injury to life, body or health, or any rights you have under mandatory consumer law.

12. App Store

If you downloaded FoodBuddy from Apple's App Store:

  • These terms are between you and us, not Apple. We, not Apple, are responsible for FoodBuddy and its content.
  • Your licence is a non-transferable licence to use FoodBuddy on Apple devices you own or control, as allowed by the App Store's Usage Rules.
  • Apple has no obligation to provide maintenance or support for FoodBuddy.
  • If FoodBuddy fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation for FoodBuddy.
  • We, not Apple, are responsible for handling any claims about FoodBuddy, including product liability, legal or regulatory compliance, consumer protection and intellectual property claims.
  • You confirm you are not in a country under a US government embargo or on a US list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

13. Law and disputes

These terms are governed by Romanian law. If you are a consumer living in another country, you keep the protection of the mandatory laws of that country, and you can bring a claim in the courts where you live. Please contact us first: most problems are solved by email.
